Burk was born in Lewis County, New York on 7 August 1840. He enlisted into the 97th New York Infantry. He died on 15 February 1926 and his remains are interred at the Lowville Rural Cemetery in New York.

At the risk of his own life went back while the rebels were still firing and, finding Col. Wheelock unable to move, alone and unaided, carried him off the field of battle.
